In a democracy, the transparency of public life constitutes an essential foundation.
The growing distrust of citizens towards institutions is fueled by persistent suspicions concerning The influence that certain secret or discreet companies could exercise, including Masonic obediences on public decisions, administrative careers or legal proceedings.
These affiliations, when they are not made public, are likely to generate conflicts of interest contrary to article 6 of the European Convention on Human Rights, which guarantees the right to a fair trial.
This bill aims to establish A declaration of declaration belonging to any Masonic, esoteric or occult organization for public officials, and to create A public national register freely viewed by all.
Text of the bill:
Article 1: Purpose of the law
Establish rules of transparency and incompatibility concerning belonging to organizations of a Masonic or occult nature, in order to prevent conflicts of interest within the State, administration and justice.
Article 2: Obligation to declare
Any deputy, senator, magistrate, senior civil servant or public service agent exercising management functions must declare his membership, if necessary, to any so -called discreet, esoteric, initiatory or Masonic organization.
Article 3: Public register
Creation of a national register of memberships to organizations of a Masonic or occult nature, under the authority of the High Authority for the Transparency of Public Life. This register is public and freely available.
Article 4: incompatibilities
Belonging to a Masonic or occult organization is incompatible with the exercise:

of jurisdictional functions (magistrates of the siege or prosecution);

management functions in the sovereign ministries (Justice, Interior, Defense);

command functions in the police or the gendarmerie;

of national elective mandates in progress, unless prior public declaration.
Article 5 : Sanctions
The breach of the declaration of declaration provided for in article 2 is liable:

ineligibility to elective mandates for a period of five years;

Article 6: Entry into force
This law comes into force six months after its promulgation. A decree in the Council of State will specify the methods of application.
