The Court of Appeal confirmed a sentence criticized by the victim’s family, leaving a waitress who killed an intoxicated client at the exit of a bar to serve his sentence of detention at home rather than behind bars.

On the night of June 2 to 3, 2022, Pierre Landry had the misfortune to meet Ariane Desgroseillers-Lafrance in the parking lot of the Vegas bar, in Longueuil.
The woman, who had just finished her quarter of work, was on her car when she saw Mr. Landry nearby. The 70 -year -old man was so intoxicated that he had to rest on vehicles to maintain his balance.
The accused then came out, had bypassed her car to join him and punch him in the face.
The deadly altercation occurred at the Le Vegas bar in Longueuil.

Mr. Landry had indeed dropped and had violently hit his head on the ground, which was fatal to him.
Plus an “accident”
At the end of a trial last year, a jury condemned the waitress of manslaughter.
The crown had suggested a three and a half year -old sentence of firm detention for this “free crime”.
But judge Daniel Royer had rather sentenced the delinquent to a penalty to serve in the comfort of his house.
According to him, the punch brought to the eye was a gesture that came closer to “the accident”.

He had noted the imposing template of the victim compared to that of the accused. And although Mr. Landry did not cause the altercation, relying on the waitress vehicle, he was then an “intruder on [son] Well “and it is” reasonable for a person to defend their property “.
Disappointed family
“We wonder if the sentence would have been the same if the sexes had been reversed and that he was a young man who had struck a 70 -year -old lady,” said Anaïs, the daughter of Pierre Landry, disappointed.
The latter had the impression that the judge had reproaches to make his father.
Recall that a few months after the drama, Desgroseillers-Lafrance had once again been accused of having taken it to another person, after a festive evening in bars. The 35 -year -old woman recently pleaded guilty and received probation.

“We just hope that she will not make other crimes,” added the victim’s daughter.
The judge also had not taken into account the a history of drug trafficker from the accused, who crossed the border with 182 kilos of cocaine in a car. It earned him four years in detention.
According to the magistrate, it was a distant and non -violent event.
