Cookshire electric popee loses its corporate license

The electrical work company has tried to make this decision in charge of a request for a provisional order as well as an official dispute in the last months, but in both cases the appeals have been rejected by the Administrative Labor Tribunal (TAT).

Bruno Goyette is the only shareholder of the company. He is also the leader and president.

On June 6, 2023, Mr. Goyette was arrested for possession of narcotics in order to make the traffic, negligent storage of a firearm and ammunition, unauthorized possession of a firearm and a contravention of an order for the prohibition of firearms.

At the time of his arrest, he had around 1,200 metamumphetamine tablets in his possession and 330 grams of cocaine.

He received 42 months in prison and obtained parole last January.

In 2019, Bruno Goyette was also arrested, accused of assault and sentenced to 18 months’ imprisonment. However, this conviction was acquitted by the Quebec Court of Appeal.

After the analysis of the file, the CMEQ committee considers that it would be contrary to the public interest to maintain the license of the company.

“The committee is not convinced that an ordinary citizen would trust the company and Bruno Goyette, or that a reasonable person would feel safe to entrust them with the execution of work in his residence, can be read in the judgment dated March 13. The objective of the law is to ensure the protection of the public. […] The committee is of the opinion that the risk of recurrence is high. “

However, the committee noted as a factor attenuating a “deep awareness of Bruno Goyette of the gravity of his actions and their consequences on his life both personal and professional”.

Mr. Goyette also received a strong support from the Correctional Services agent Sébastien Paradis.

The latter testified that “Bruno Goyette is sincere in his desire to change his life, overcome his problems of consumption of narcotics and bait of gain, and reintegrate into society”.

Rejected appeal

Mr. Goyette opposed the revocation of his license since he considers that his business has no connection with his convictions. He notably presented several letters of recommendation from his transitional agents and customers.

However, the TAT did not backtrack since the appeal aimed to obtain a new analysis of the facts and a different conclusion.

“The law does not grant this power in court, can be read in the judgment of July 18. In the absence of a manifest and dominant error in the decision, the court does not have to intervene or substitute its opinion for that of the corporation. ”

The company will therefore be able to file a new license request in five years.

“The flow of time will then allow the Committee to exercise its discretion to determine if Bruno Goyette has shown his morality and his probity.”

In addition, given the imprisonment of its manager, the company will not be able to bid on public contracts for a period of five years.
