A federal judge again suspends Trump’s decree returning to the law of the soil

An American federal judge again suspended the decree of President Donald Trump again on Thursday to return to soil law in the United States, one of the most disputed of his new mandate.

All the courts. Moreover, courts of appeal which had been seized had already suspended throughout the territory the entry into force of this decree, considering it as unconstitutional.

But the majority conservative Supreme Court. Meanwhile, seized by the Trump administration, limited the power of judges on June 27 to block the decisions of the executive which they consider to be illegal.

The Trump administration asked the Court not to lift the suspension of its decree at this stage. but to limit the scope of suspensions to only persons who seized justice.

A federal judge of New Hampshire (northeast) suspended the decree in turn on federal judge again suspends trump’s Thursday. but this time as part of a group action in the name of any person born in the United States from February 20 and therefore potentially affected.

The influential ACLU civil rights organization. one of the associations engaged in this file, welcomed in a statement that this decision “protects the rights to the citizenship of all children born on American soil”.

“Since the decision of the Supreme Court. parents have lived in fear and uncertainty, wondering if they should give birth to their children in another state and if their babies were likely to be expelled,” said Aarti Kohli, director of the NGO Asian Law Caucus, cited in the text, welcoming a “major victory”.

The judge postponed the entry into force of his decision to give the government to appeal. but this will take place in any case before July 27, due to the Supreme Court to allow the federal judge again suspends trump’s Trump administration to partially apply the decree, underline the associations.

The Supreme Court did not rule on the constitutionality of the presidential decree. but authorized federal agencies to develop and publish directives as to its application, from a month after its decision.

The decree prohibits the federal government from issuing passports. citizenship certificates or other documents to children whose mother illegally or temporarily stays in the United States, and whose father is not an American citizen or permanent resident – holder of the famous “green card”.

Donald Trump signed this decree as soon as he arrived at the White House on January 20. saying wanting to fight illegal immigration.

The principle of soil law. devoted by the 14th^e Amendment to the Constitution, making it that any child born in the United States is automatically American citizen, has been applied for more than 150 years.
