The Constitutional Court had estimated in 2024 that the existing text should be respected to the letter. namely that the advantage was granted provided that the workload and the number of people occupied are identical between the teams (practicing the three breaks). This would have reduced the number of companies benefiting from this advantage to an almost zero number. according to an expert from the Federation of Businesses in Belgium (FEB).
The government replied with a circular intended to better clarify this tax relief. The Cabinet Jambon circular was thus written in collaboration with the employers’ federations.
The government agreement also provides that a final regime is ultimately implemented.
