Vaudois justice obliges the police to disclose their radar data

Morges region police (PRM) will have to provide radar statistics or justify its refusal, according to a recent judgment of the Court of Administrative and Public Law (CDAP) of the Vaud Cantonal Court. The judges agreed with a citizen of Buchillon who claimed information on the speed controls carried out in his commune.
The applicant, Kyril Gossweilerresident of Buchillon, activist for transparency, had requested orally with the PRM “the statistical surveys of the last five giraffe speed measures in Buchillon”. Faced with the police requirement to go through his internet portal, the citizen challenged this procedure, believing that she was contraveking the Vaudoise on information law (LINFO).
An unanswered month
After more than a month without response to his email from February 25, 2025, the applicant seized the CDAP for denial of justice. Although the police finally responded during the legal proceedings, the latter maintained that the use of their portal was compulsory for computer security reasons and returned the citizen to the annual report available on his site.
“I made this request in a state of prevention,” reacts Kyril Gossweiler. These radar statistics are by definition public data, moreover useful. I regret that it was necessary to go through the CDAP to obtain them. In the canton of Vaud, some policies hardly manage the law on transparency, in my opinion. ”
In its judgment, the Court recalls that the LINFO provides that a request “is not subject to any requirement for form” and that the authority must meet within fifteen days. The judges also considered that the most recent annual management report (on June 26, 2025) available on the PRM website was the 2023 report. And that it did not contain “statistical statements of the last five campaigns – from February 25, 2025 – of speed measures in Buchillon”.
The CDAP therefore refers the file to the PRM, entitling either to communicate the required information, or to formally motivate its refusal by specifying the possible “preponderant interests” which would oppose their transmission, in accordance with the LINFO.
