According to the judge. the fact of temporarily depriving young transgender access to this care could expose them to permanent physical changes which do not correspond to their gender identity. which constitutes a serious risk for their psychological and physical well-being.
The legal recourse has been filed by rights defense groups LGBTQ+ and by several families. They claim that the law violates the rights protected by the Canadian Charter of Rights. Freedoms, in particular the security of the person, the right to equality and protection against cruel or unusual treatment.
In response to the decision, Naheed Nenshi, deputy for Edmonton-Strathcona, praised a judgment which, according to him, protects young Albertans.
