The Geneva justice must once again look at the dispute between Rolex and a watch customization workshop. Indeed, the judges did not take into account the directives of the Federal Court in a decision attacked by the watch brand.
(Keystone-ATS) Created in 2013, the company Artisans de Genève SA offers a personalization service for luxury watches. Seized by Rolex, the Geneva Court of Justice prohibited this activity in 2023. A year later, the Federal Court admitted it, on the contrary, provided that the workshop works only on watches provided by its customers and that they are not sold.
My rest, however, invited the Court of Justice to examine whether the references to Rolex on the Geneva craftsmanship website contravened the law on the protection of brands or the law on unfair competition. In a judgment published on Monday, the judges of my rest find that the requested analysis was not carried out by the previous body.
