Charlie and Benoît recently opened their seventh Horeca establishment, this time located in Uccle, rue Vanderkindere. A musical restaurant, which is experiencing “a great success”, according to its managers … to the chagrin of certain neighbors.
“We have been there for two months and we have not expected that there are so many people, we are even a little overwhelmed,” admits Benoît, one of the managers. An exciting new adventure for the two partners, which nevertheless begins to become “great frustration”.
“Strong discussions”
And for good reason. The arrival of the “Boaboa Records Bar” does not appeal to everyone in the neighborhood. After two years of an empty cell, the nuisances driven by the establishment become “increasingly worrying”, according to Léa, which pressed the orange button alert us.
“For several weeks, residents have undergone recurring night’s nocturnal noise,” she writes to us. “Customers occupy parking spaces, which challenge residents by windows, laugh and have strong discussions until late at night …”
“It’s been years that there has been a bar in front of that one and we never have problems,” continues our alert tree. “It’s another clientele,” she concedes.
Léa claims to have contacted the police many times to report the problems. But in vain. “Nothing changes despite our calls” and, according to this neighbor, no observation was drawn up by the police. “It’s complicated to live. We feel abandoned. »»
“The police go there”
Contacted by RTL Info, Valentine Delwart, the Uccloise alderman in charge of the Horeca confirms having knowledge of this file. According to her, the managers of the Boaboa are in good faith and attentive to the problems exposed by the neighborhood, whose worries also stand out on several Google opinions. “The police go there and reports on the situation, but there was no influence of noise,” said the elected official, while specifying that the schedules of police officers do not play these unrelated observations. For Valentine Delwart, “managers make a maximum of effort to reduce nuisance and pay particular attention to complaints”. “Sometimes some establishments do not want to hear anything, this is not the case here. The neighborhood is surely disturbed because it has experienced peace for a long time, when the places were empty. »»
The municipality indicates closely monitoring the situation and counts on the dialogue to settle it. “It may be that for this kind of problem, fines are given, but we are not there at all.”
We find some neighbors a little aggressive
For its part, the new restaurant-bar is disturbed by such a start. “We are in an attractive district of Uccle where there are several bars, and with us the police come from 10:05 pm … We find it a little aggressive certain neighbors, who do not come to speak to us and directly call the police. We immediately arrived in a situation where we do not have the right to make mistakes … “
Managers of the establishment and the municipality both assert that systems have been put in place to limit the embarrassment. “We close the terrace at 10 p.m., which is the problematic place of our establishment, and we remove the chairs so that customers do not stay outside,” says Benoît du Boaboa. “We have put posters and ask that everyone is coming back once the cigarettes are finished. The noises that the neighbors hear are nothing other than the noises of discussion … “
While Léa’s anger is waiting to be heard, the establishment is waiting for its “consultation with everyone in order to be able to confront”. The alderman in Horeca in charge of Horeca hopes to be able to settle things “amicable”.
What to do in case of noise?
- Try first to chat with the bar manager to report the inconvenience caused to him
- If the dialogue gives nothing, send a registered letter to the operator to formalize your request
- Contact social mediation to try to find an amicable solution
- Contact the police so that they can make observations
- Gather evidence (testimonials from neighbors, recordings, bailiff’s report) if the nuisance is regular, to facilitate any legal procedures
- In the event of prolonged inaction, seize the justice of the peace for abnormal neighborhood disorder and request compensation
