The 40-year-old man who studies at Cégep de Victoriaville underwent his survey on release on Tuesday afternoon. Represented by Me Jonathan Poirier of legal aid, the accused promises to no longer be on the territory of Sherbrooke if he is released. It also offers monitoring in terms of alcohol consumption.
“These guarantees allow the court to believe that they are serious. […] Clearly, you have a problem of alcohol consumption. When you say that 10 beers is not exaggerated, it is worrying, “said judge Hélène Fabi.
The identity of man was not revealed so as not to identify the victim.
Strangulation
The accused would have, under the influence of alcohol, strangled his spouse twice on July 27.
It is by returning home, when he would have led into intoxication, he would not have closed the door of his vehicle before entering the house.
Questioned by his spouse, the man would have taken the arm of the latter. The woman would then have struck him to defend herself.
It was then that the accused would have strangled the woman for the first time. Then a second.
“He would have mentioned that he was going to kill her, aggressively. He was standing and put his weight on her, “the prosecutor reported criminal and criminal prosecution on the file, Me Sabrina Major.
The police intervened after the victim’s daughter, who was in the basement, filed a complaint. The latter had heard the threat of death.
The man was then arrested and then accused of assault by strangulation, forcibleness and conduct with the weakened capacities, among others.
“Met in interrogation, he mentioned that he was acting in self -defense,” said Magin.
The crown would have agreed to let out the accused if he had agreed to follow closed therapy and to wear an antirapproache bracelet, to which the defense did not agree. The accused would have missed his period of examination because of his detention.
Rather, it offers to live in a Warwick mutual aid center before joining the Cégep de Victoriaville residences. He is also open to following external therapy for his alcohol problem.
“It’s not that I can’t eat. Is that the week I have my children, I don’t drink at all. But when I start drinking, I have trouble stopping, “he pleads.
The drugs he takes to treat his bipolarity can multiply the effects of alcohol.
If he stopped drinking for two years, he started again when he separated from the mother of his children. “It was a moment of weakness,” he says.
He says “very well” master his emotions when he does not drink alcohol. However, he never carried out any follow -up in the matter.
Other file
The individual also faces another accusation of assault, this time against his son aged about fifteen years.
He would have hit him in the face.
The man who has no criminal history must be present at the court at all stages of the procedures, to reside at the volunteer mutual aid center, to respect a curfew between 10 p.m. and 7 a.m. and not to contact his ex-spouse. He will not have the right to have a weapon.
He will not be able to consume intoxicating substance and will have to perform external follow -ups with a dependence intervention center twice a week and will not be able to be in Sherbrooke, except to pick up his personal effects.
“I hope alcohol is over for you,” said the judge.
He will return to court on October 2.
Because of an imbroglio concerning the other file, the individual should resume his freedom only on Wednesday.
