Justice-the recovery of an inmate who has just been transferred to the High Security Prison in Vendin-le-Vieil (Pas-de-Calais), Me Philippe Ohayon, announced this Thursday, July 24, that it had filed a complaint for abuse of authority against the Minister of Justice Gérald Darmanin before the Court of Justice of the Republic (CJR).
The complaint, which AFP was aware, reproaches the Keeper of the Seals for having ordered this transfer “By freeing yourself from the obligation to establish pre -existing links between the prisoner, since detention, and organized crime or delinquency networks”obligation however posed by the Constitutional Council as a prerequisite for these transfessions.
In doing so, “The Keeper of the Seals or his delegate has shaken up the legal conditions set by the Constitutional Council”is it estimated in the complaint. The CJR is the only body empowered to judge ministers in the exercise of their functions.
The kick-off of incarcerations in the High Security district of Vendin-le-Vieil, intended to accommodate the 100 most ” dangerous “ of the country, was given Tuesday, with the first 17 prisoners who were transferred to it. Twelve other detainees were imprisoned on it on Thursday, said Gérald Darmanin on X.
Another high security district is to go into office in mid-October to Condé-sur-Sarthe (Orne) prison, to also accommodate 100 people. The objective of these districts is to place these detainees completely isolation, according to a very strict detention regime inspired by the antimafia fight in Italy. In mid-June, the Constitutional Council validated this prison regime of isolation, included in the law aimed at combating drug trafficking, believing that the legislator had “Defined with sufficient precision the reasons for assignment in the neighborhoods of combating organized crime”.
“Links established” vs “supposed links”
The provisions of the law “Subordinate the assignment decision in these districts on the condition that they are established that these detained persons continue to maintain links with the crime and delinquency networks organized during the duration of their detention or that they have established such links”had observed the council.
However, according to the complainant, convicted of offenses on drugs on narcotics and arms and suspected of criminal criminal association, the penitentiary file “Only only indicts, from procedures, moreover, an ability to establish links” with organized crime.
