Requests for authorization for collective shares filed against Volkswagen and Nissan in Canada

The first request against Volkswagen Group Canada Inc. aims to obtain payment for the repair of damage to members of members due to a defect affecting the windshield of ID.4 vehicles, as well as damages and punitive damage.

The cabinet notes that a premature crack phenomenon has been noted on this kind of vehicle in recent years and that Volkswagen refuses to repair these breakage.

The limited conventional warranty for new Volkswagen Group Canada ID 4 -4 -year vehicles is four years or 80,000 kilometers. However, Lambert Avocats notes that in Quebec, “owners of new vehicles keep their cars on average more than eight years, including about a third of them between 11 and 15 years old”.

To illustrate its request, the firm mentions the history of one of its customers, whose windshield crashed while its vehicle was parked that the heated windshield function was lit. He then quickly went to his dealership and noted that the crack is growing when he parked his car in the heated garage of the establishment. During the vehicle examination, the concessionaire nevertheless claims that it is a breakage caused by an impact on the road and therefore refuses to repair the windshield free of charge.

“Our customer believes that it is unreasonable that the windshield of his vehicle has such a great degradation after 10 months of use and 16,500 kilometers of use, when he has always maintained his vehicle well and has taken care of it since its purchase,” notes Lambert Avocats.

All people who have bought or rented a long -term Volkswagen ID 4 brand vehicle can participate in collective action.

Nissan also targeted

More recently, on July 28, Lambert Avocats also applied for collective action against Nissan Canada Inc. for painting problems observed on certain white vehicles.

A member has indeed noted a significant scaling up of the painting of her vehicle, which she rented, then bought, over a period of six years, despite reasonable use, neat maintenance and cautious driving. His dealer refused any free repair, invoking the expiration of the guarantee.

“Our customer would not have bought this vehicle, or paid for such a price, if it had been informed of this problem directly affecting the quality and reliability of the property,” deplores the firm.

According to Lambert Avocats, hundreds, even thousands, consumers could be affected by this situation and the cabinet accuses Nissan of a lack of transparency.

“The vehicles distributed by the defendant have a serious defect, that is to say a premature scaly of the painting directly affecting their appearance, their sustainability and their market value. Buyers expect the body of their vehicle to be protected by a sustainable, properly applied paint and capable of preventing wear and corrosion in normal conditions of use for a reasonable period of time, “said one.

The demand for collective action concerns all those who have bought or rented long -term a Nissan brand motor vehicle in white color. To participate, simply fill out this form.
