Apple wins its appeal trial in the United States concerning iCloud storage

The United States Federal Court of Appeal rejected on Wednesday the accusations brought by Apple customers, according to which the iPhone manufacturer would have provided them with less iCloud storage space than for which they had paid during an upgrade.

In a unanimous decision (3-0), 9e United States Court of Appeal in San Francisco considered that reasonable consumers, as part of this proposed collective action, would not have been deceived by Apple’s promises concerning the storage capacity of its iCloud+offers.

The complainant, Lisa Bodenburg, claimed to have paid $ 2.99 per month for 200 GB of storage, thinking that Apple would add this quantity to the 5 GB offered for free to all iCloud users, and that she had therefore been injured by receiving only 200 GB in total, instead of the expected 205 GB.

Judge Milan Smith, however, considered that Bodenburg had “received exactly what Apple had promised him” when the company based in Cupertino, California, proposed “additional” or “additional” storage in addition to the 5 free GB.

He quoted discharges from other cases based on “unreasonable hypotheses”, such as that according to which the Diet Dr. Pepper would help to lose weight, or that the net weight indicated on a lip balm did not specify that the design of the tube made part of the product inaccessible.

“Apple’s statements are neither false nor misleading simply because they could be unreasonably misunderstood by an insignificant and non -representative fraction of consumers,” wrote Smith.

Ms. Bodenburg’s lawyers did not immediately respond to the requests to comment on the decision. This confirms the rejection pronounced in May 2024 by the district judge Trina Thompson in San Francisco.
