New twist in the legal conflict between the commune of Estavayer and the company Hôtel du Lac and restaurant of the landing up (HDLRD SA). In a judgment rendered in June, the Federal Court confirms that a prior formal notice was necessary to validate the area of area, contrary to what had been decided previously.
The case dates back to June 2017, when the municipality of Estavayer had denounced the surface contract concerning the plot of the Hotel du Lac. Favorable decisions of the cantonal courts in 2021 and 2024 had followed, according to the observation that the company seriously violated its maintenance and operating obligations of the building.
The Federal Court considers that these shortcomings do not justify immediate termination without prior notice.
The Staviac authorities must now choose whether they wish to formulate a new termination while respecting the formal notice or abandon the proceedings. The Hotel du Lac and its restaurant have been abandoned for almost 10 years.
