Moratory on construction: Lévis pursued for $ 7M

The city of Lévis is continued for $ 7 million in total by two promoters who claim damages due to the moratorium on construction projects which applies to two thirds of the Lévisian territory.

The promoters Cocité Lévis and Development L’Aquifer, who had projects in motion on the territory of Lévis, both brought up prosecution of damages in the Superior Court against the city of Lévis.

They demand $ 5M and $ 2M respectively. “Cocuity is the victim of the city’s actions in that the city deprives her of developing a major real estate project on her land after having agreed with her that she would carry out municipal infrastructure work at her expense,” writes Cocuity in her request.

On a break

The work in Saint-Nicolas, near the Pierre-Laporte bridge, was carried out for the benefit of the city and the latter then put on pause any residential development and refused to issue the construction permit for the seven buildings project, adds the company. This is “unreasonable” and is “laxity”, she said.

The administration of the mayor Gilles Lehouillier has indeed declared a moratorium on construction projects on two -thirds of its territory due to the lack of capacity of wastewater treatment networks, which caused discontent among promoters.

A similar situation occurred with development in aquifer, as part of the Elevation 3 district project, with five buildings, in Saint-Nicolas, according to the documents deposited in court.

After carrying out municipal infrastructure work by the promoter, the city refused its minor derogation request and asked it to submit another request for a license in accordance with the regulations.

This was done, indicates the request, but the city then put the development on a break.

“Bad faith”

“The city knew that its wastewater management and treatment capacities should be enhanced and it did not take the relevant gestures in time to satisfy its commitments,” argues the aquifer, raising the “bad faith” of Lévis.

For this, the two promoters demand damage totaling $ 7 million for loss of income and credibility, for additional interest costs to pay and for significant disbursements caused by this situation, in particular.

They also ask the Court to enjoin the city of Lévis to issue their construction permit.

The city of Lévis had not reacted when writing these lines.
