Three legal fights, three victories of David against Goliath. The last one was announced Monday August 4 by the Community of communes of the island of Oléron (CDCIO), a winning release of its trial against Leboncoin. Among its dozens of services related to classified ads, the French company connects housing owners and vacationers, with online payment, just like Airbnb or Booking. In his decision rendered on July 29, that Libération Consulting, the La Rochelle judicial court ordered Leboncoin to pay a total of 410,000 euros to the CDCIO for non-application of the tourist tax during the summers 2020, 2021 and 2022.
During a few euros per night, the 384 stays concerned represented a dispute of 22,000 euros between the two parties. Leboncoin invoked the right to make mistakes. The court rejected this argument. “We take note of the decision of the La Rochelle judicial court, even if the pronounced fines seem clearly disproportionate to the facts”, reacted Leboncoin to Liberction. Concerning a possible call, “No decision was
