“The crimes committed by Adam Fatheddine are serious, his moral guilt is high. In this context, the principles of denunciation and deterrence must have a particular resonance, ”thunders the judge Martin Chalifour, from the Court of Quebec.

In his recent judgment, we learn that police were called on June 4, 2023 for possible drug transactions in Montreal-Nord. Agents of the Montreal City Police Service (SPVM) went to a residential street around 2 a.m.

Five men were then on the spot, including Adam Fatheddine.

“The latter carries a type shoulder bag man pursewhich draws the attention of the police. In the light of various observations and with specialized training, the exciting policeman believes that a firearm could be there, ”reads the legal document.

Betrayed by his bag

The police therefore ordered Fatheddine to show the content of his bag. The twenty -year -old, who works in a wedding dresses trade, immediately refused and took the escaped powder.

“During his race, he launched his bag on the ground. He is finally under control a few meters further. Once this arrested, the police recover the item, ”says the judge.

Inside, they found disturbing elements: a firearm that “was loaded, ready to shoot”, a hood, a hunting knife and a “prohibited device”. Note that an identity document in the name of Montrealers was also found in the bag.

Adam Fatheddine’s lawyer also asked that this element be withdrawn from the proof, arguing that the police did not have the authorizations to inspect his bag.

“This excavation was legal. She was just as much a few moments later after the applicant’s flight and [après] that he got rid of it. This leakage behavior offered an additional incriminating base, ”replied Judge Chalifour.

A good lesson

The court finally declared the young man guilty of four charges, including possession of a weapon with restricted authorization and port of concealed weapon.

He will therefore spend the next 22 months behind bars. Fatheddine’s lawyer pleaded for a prison sentence, but the request was refused by the judge.

“In this case, the crime is serious and the responsibility of the offender in it is high. Neither the young age of Fatheddine, nor his absence of judicial history, nor its rehabilitation of appearance can overshadow the weight that the objectives of denunciation and deterrence must receive here. […] A firm detention sentence is essential, ”concludes the court.
