Strike at Air Canada: a request for collective action authorization filed against the union

“This request aims to obtain repair of damage suffered due to the cancellation of Air Canada flights since August 17, 2025,” it said by press release.

The applicants criticize the SCFP for having continued the strike even if the Canadian Council for Industrial Relations (CCI) ordered a resumption of work. The union had then announced that it challenged the CCRI order.

“The SCFP’s decision to maintain its illegal strike had the effect of extending and aggravating the massive cancellations of Air Canada flights,” said Lambert Avocats.

The applicants cite several damages which they have endured and which could have been avoided according to them if the SCFP had respected the order of the CCRI. Among these, they quote:

  • Unused accommodation costs;
  • Additional accommodation costs;
  • Meal costs;
  • Unused motor vehicle rental fees;
  • Additional motor vehicle rental fees used;
  • Additional costs for the reservation of another flight;
  • Lost vacation days;
  • Income loss;
  • Stress, anxiety and disappointment

The group of applicants therefore claims that the SCFP pays them compensatory damages.

“To date, we are still awaiting a response from the SCFP and a hearing date on the authorization of collective action. A judge of the Superior Court will then have to assess the merits of our request, so that our client is authorized to exercise the collective action against the SCFP, “specifies Lambert Avocats.

People targeted by collective appeal are automatically part of the group of applicants, but it is possible to follow the steps of the process on this website.

About 130,000 customers will be affected for each day of suspension, said Air Canada.

“We are deeply saddened for our passenger and passengers. We do not want to go on strike and we do not want to be lockout, but it is clear that Air Canada had no intention of negotiating, “said the SCFP.
