There is already a procedure which consists in taking financial measures against persons who carry out illegal activities by automatically assigning them the social status of independent. This is done via Inasti, the National Institute of Social Insurance for self -employed workers. This procedure will now be systematically applied to people identified or arrested by the police, in particular for the sale of drugs, but regularly ignored by overloaded justice.

A simple PV is enough

Concretely, this will work on two axes: automatic transmission of judgments and the use of police findings. From now on, all legal decisions concerning drug trafficking will be systematically transmitted to Inasti. Please note, affiliation can be retroactive up to five years! So how much will it cost an average dealer? This will depend on years of black work whose inasti can demonstrate existence. An affiliated and independent trafficker will have to pay social security contributions at the rate of 20.5 % on his taxable net income. To give an idea: the current minimum contribution amounts to 871.71 euros per quarter.

But that’s not all. Take the example of a dealer that has generated comfortable income for five years. Affiliation to Inasti has other consequences. The people concerned lose access to benefits such as unemployment benefits (ONEM), family allowances, CPAS aid, scholarships or social housing, depending on their situation. Other sanctions, such as seizure of property, remain possible via legal proceedings.

The implementation of this procedure can be done fairly quickly. It does not require being discussed within the government because all legal provisions are already in force. The Cabinet Simonet will however examine, in consultation with in particular the Minister of the Interior Bernard Quintin (MR), how to structure the transmission of information to the Inasti in a lasting way.

Legalization of traffic?

From the moment when the drug deal is perceived as an activity for which contributions and taxes must be taken, should we consider drug trafficking as a legalized business? “Absolutely not”, insists the cabinet Simonet. “”This measure adds a layer of financial sanctions in addition to existing criminal proceedings. The objective is to fight impunity by forcing criminals to pay social contributions, not to legitimize their activities. “
