Only people from regions of Ukraine where their life or physical integrity is concretely threatened will be able to obtain the status of protection S in Switzerland. The Federal Council decided on Wednesday, pushed by Parliament.
Before possibly granting status S, the State Secretariat for Migration (SEM) will now have to distinguish the regions of Ukraine which are considered to be sure of those deemed dangerous. Clarifications are underway to qualify the various zones, writes the Federal Council in a press release.
According to the SEM, several regions of the west of the country controlled by Ukraine currently know no intense combat. In the future, people domiciled in these regions will not be granted the status S that exceptionally. The security situation is constantly evolving, the list of areas considered safe may be adjusted at any time. People excluded from status S will remain free to file an asylum application in Switzerland.
Restriction of travel too
Another change in view, beneficiaries of status S will now be authorized to stay in their country only 15 days per semester. Currently, the beneficiaries of this status are authorized to stay in their country up to 15 days per quarter. SEM can withdraw status S from a person who stays repeatedly or prolonged in Ukraine.
The Parliament supported during the winter session 2024 three motions from the right aimed at tightening the screw on the status S. The Federal Council must therefore implement them, even if it was opposed. A Consultation procedure must be opened at the end of next October.
