Belgium even more hardens family reunification

The Belgian House of Representatives approved, on the night of Thursday to Friday, the bill which makes the conditions for access to family reunification. The text, presented by the Minister of Asylum Anneleen Van Bossuyt, was supported by the majority of Belgian parties.

The bill aims to reduce the number of entries on Belgian territory by this route, which is one of the main migration channels. The measures specifically target persons benefiting from international protection, whose visa requests for this reason increased from 9,358 in 2023 to 13,102 last year.

One of the main changes concerns the income condition imposed on the grouping. The reference amount is increased to 110 % of the guaranteed minimum monthly income, or 2,323 euros. This threshold will be increased by 10 % for each additional family member. The Council of State had made a criticism of this provision due to the absence of a ceiling. The minimum age for grouping is also noted at 21 years.

In addition, waiting times are changed. The period allowing the members of the recognized refugee family to join the country unconditionally is reduced to six months. For beneficiaries of subsidiary protection, this period is deleted, a difference in treatment which raised the concern of the Council of State. The general waiting period before a newcomer can start a family reunification procedure is also extended.

To summarize therefore:

• The new threshold is € 2,323 per month, or 110 % of the guaranteed minimum income.

• This amount increases by 10 % for each member of the additional family.

• Age to be able to benefit from family reunification is now 21 years.
