Erwin Sperisen filed a criminal complaint with the Geneva public prosecutor against several judges of the Geneva Court of Appeal for abuse of authority and abuses in the honor. His lawyer requests the appointment of an extraordinary extracantonal prosecutor.
In his criminal complaint, the former head of the Guatemalan police criticizes the judges for having deliberately violated the presumption of innocence in defiance of the penal code, ignored the instructions of the highest judicial body and maintained at the trial a civil party deceased for a long time, wrote his lawyer Dominic Nellen on Saturday in a statement.
The Sperisen case has been tried several times by national and international courts. In 2023, the European Court of Human Rights (ECHR) sentenced Switzerland to violate the right to a fair trial.
Erwin Sperisen was again sentenced to a complicity in assassination in September 2024, with a judgment which, according to La Défense, clearly constitutes an abuse of power “.
