The 34 -year -old woman – who cannot be identified – faces charges of child abandonment and criminal negligence causing injuries. Her three -year -old daughter was found on the edge of a highway in Ontario, three days after her disappearance. A story followed across the country.
Judge St-Arnaud was to rule on Friday on a crown psychiatric assessment on Friday. In a brief decision, the judge concluded that there were “reasonable reasons” to believe that an assessment was necessary. Thus, the accused will be assessed to determine her criminal responsibility at the time of the facts.
Then the judge rendered his decision on the release of the accused. He decided that it was necessary that it remains detained throughout the legal process. This decision is covered by a large ordinance of non-publication, normal at this stage of the judicial process. This prevents us from relating the evidence presented, the testimonies heard and the judge’s analysis.
This decision was received by tears by the accused in the accused box.
