Mohamed L., the murderer of Alban Gervaise, was declared criminally irresponsible by the investigating chamber of the Aix-en-Provence Court of Appeal this Wednesday, June 25, learned Le Figaro of a source close to the file. He will therefore not be judged by an assize court, thus escaping the prison, but will remain hospitalized under constraint for an unknown period to date.
This decision was expected, the three psychiatric expertise carried out during the investigation which concluded that the murderer of the murderer was abolition at the time of the facts. A barbaric murder
Alban Gervaise, 40, was killed on May 10, 2022 near the Catholic school group Sévigné, in Marseille. The father came to seek his two sons 3 and 7 years old at school. Installed in his car, with his 20 -month -old daughter in a car seat at the rear, the military doctor was attacked by Mohamed L., 23, suddenly mounted on the passenger side.
The assault continued outside the vehicle. The assailant, without a criminal record but known to the police for drugs of drugs, continued him on foot over twenty meters and then pushed him into a bay leaf where he stabbed him on ten times, especially at the level of the heart. Hospitalized in psychiatry
Mohamed L. was imprisoned in Baumettes prison, in Marseille, from May to August 2022 and then transferred to a psychiatric hospital, within unit for difficult patients (UMD), after trying to attack a prison supervisor. In June 2024, he was transferred to a specially developed hospital unit (UHSA), welcoming individuals considered less dangerous.
Individuals not accessible to a criminal sanction can, in theory, be hospitalized for several years, even their whole life for some. It all depends on their pathology and the nature of the facts committed. What deadline will the murderer of Alban Gervaise be released? Difficult to say at this stage. One thing is certain: two psychiatric experts will have to validate its release.
