The Grenoble administrative court canceled on Monday July 21, the obligation to leave French territory (OQTF) which was issued on January 5 to Imad Ould Brahim, the Algerian influencer known as “Imad Tintin”. The latter had been arrested on January 3, and prosecuted for “direct provocation to an act of terrorism” after violent remarks made on his Tiktok account, which had finally been reclassified as “threats” by the Grenoble court court. In parallel to this legal proceedings, an OQTF had been issued by the prefecture of Isère against this resident of Échirolles, a neighboring town of Grenoble. It follows two similar procedures, which occurred in 2022 and 2023, that Imad Ould Brahim had not respected.
At the beginning of July, during a hearing before the Grenoble administrative court, Me Alexandre Rouvier had argued that the 31 -year -old influencer was now a father of a little girl, born in December 2024 and in French nationality. Imad Ould Brahim had also made a residence permit to the prefecture, dated December 29, 2024, after the birth of his daughter, invoking the reason for “private and family life”.

In their decision rendered on Monday, the judges refer to the agreements concluded between Paris and Algiers, adding that a “One -year -old certificate of residence with the mention “private and family life” is automatically issued to the Algerian national, direct ascendant of a minor French child resident in France, on the condition that he even partially exercises parental authority towards this child or that he actually subjected to his needs.»

Provisional residence permit
Believing that the prefecture of Isère should have verified whether a residence permit application had been filed, the judges acted the cancellation of the OQTF which was aimed at Imad Ould Brahim until then. The prefecture of Isère now has three months to decide on its situation and will have to issue it a provisional residence permit, within eight days, to allow it to work. The prefect has a month to appeal this decision.
This episode is added to the judicial soap opera in which this young Algerian is involved, arrested in early January and tried before the Grenoble court on May 23. The translation of the words he had made on his Tiktok account had been at the heart of the debates during the trial. Based on a new translation of the influencer’s words, made by an expert from the Court of Cassation, Étienne Manteaux, the public prosecutor of Grenoble had considered that “The just qualification of the facts at the sight of this translation, [relevait] No provocation to an act of terrorism». On June 10, Imad Ould Brahim was finally sentenced to a fine of 450 euros by the Grenoble court. The prosecution appealed this decision.
