A resident of Marsillargues (Hérault) wanted to quickly sell the house of her 87-year-old grandfather in the seven deniers district, in Toulouse, to mop up his debts and finance the medical residence where the retiree is forced to live since 2024. Problem: the town hall has argued his right of pre-emption and intends to recover the property at a very lower price.
If the expropriation judge issued a decision in favor of the granddaughter on April 8, the city finally appealed on May 19, reports La Dépêche du Midi.
A problematic situation
The municipality would like to acquire this house in order to create a passage for pedestrians and bikes between Job Square and the future metro station of the seven deniers. A year ago, she therefore asserted her right of pre -emption and offered 468,000 euros. Except that the granddaughter rejects the procedure, on the background as in form. Since the start, she does not want this house, in which she has many memories, shaved, she explained to our colleagues a year ago.
Moreover, an individual had offered more than 550,000 euros to recover the house. The Domain Service would have estimated the property at more than 600,000 euros. A sum on which she counted, while the octogenarian has debts of 55,000 euros.
Disturbing deadlines
The granddaughter feels trapped, especially since she had to go into debt in lawyers and expenses related to the medical residence. The appeal brought could still delay the sale of two years, even though the judge estimated, on April 8, that the market value of the property was very much above the price proposed by the municipality.
In the hope of making things happen, she sent a letter to Jean-Luc Moudenc, mayor of Toulouse and president of Toulouse Métropole, to Olivier Arsac, mayor of the district, and to the President of the Republic. Contacted, the town hall simply declared that “the procedure initiated under the right of pre -emption takes its course”. She had previously committed to that the deadlines do not penalize the management of the grandfather.
